| 1. The Service FlirtNet is a mobile phone match maker chat service ("the Service"). Mybeat Interactive Technologies ("Mybeat) provides the technology and management of the Service . 2. Signing up for the Service To activate and sign up to the service, a participant of the Service ("the user") is required to send an SMS message, with the word "Flirt", or respond to any automated FlirtNet message. The Service will then send the user series of SMS messages requesting various pieces of information. By sending an SMS message to the Service, the user warrants that he or she accepts these terms and conditions. 3. Age Policy The Service is only available to persons who are able to legally agree to these terms and conditions. The service is not available to minors. 4. Privacy User information shall only be collected and stored for the purposes of managing and maintaining the service. User information to be stored shall be relevant to the purposes of conducting the service. The user consents to the transfer of his or her own personal and profile information to parties associated with Mybeat Interactive Technologies until such time as the service is terminated. Mybeat undertakes not to transfer personally identifiable user information to unaffiliated third parties without the user's express consent or unless requested to do so by a legal court or appropriate governmental authority. Mybeat reserves the right to utilise personal information for the purposes of, but not limited to, statistical analyses, user surveys and studies. 6. Passwords and security The Service may introduce a registration process that requires the user to choose a password to access FlirtNet and related services. If the user suspects that someone knows your password, the user should change it as soon as possible. Mybeat shall not be liable to for the protection of user website passwords. 7. Member conduct The user hereby undertakes to use the Service in a respectable and honest manner. The user furthermore undertakes not to use the Service for the communication of pornographic, rude or slanderous messages. The user is required not to violate the rights of other users through the Service. The user undertakes not to use the Service for communication of messages which constitute "spam" mail. The user hereby accepts that Mybeat bears no responsibility for the content of messages sent and received via the service. A user may at any time, and out of his or her own free will, decide to disclose any of his/her information to another user. 8. Costs of Using the Service(s) The user knows and understands that all SMS messages sent in relation to the Service are charged at premium rates. Rates are published on this website and may change from time to time. The user must obtain permission from the bill payer before using the Service. The user accepts that free SMS packages and free minutes from the cellular operators / networks do not apply. 9. Indemnity The user hereby indemnifies Mybeat against any claim or action which may arise as a result of the user's use of and participation in the service for any reason whatsoever. 10. Jurisdiction These terms and conditions, their validity, existence or termination, or any other disputes arising in relation to these terms and conditions shall be governed and/or determined in accordance with the law of the Republic of South Africa. Both the user and Mybeat hereby consent to the jurisdiction of the High Court of South Africa (Witwatersrand Local Division) in respect of any disputes relating to these terms and conditions. 11. Whole Agreement These terms and conditions constitute the entire agreement between the user and Mybeat. Mybeat reserves the right to amend or revise these terms and conditions at any time, notification of which will be published on the website. 12. Severability If any one or more of the provisions of these terms and conditions should be held invalid or unenforceable the validity and enforceability of all other provisions hereof shall not be effected thereby. Such invalid or unenforceable provision shall then be deemed to have been deleted without affecting the validity and enforceability of the remaining provisions of the terms and conditions.
